1. Agreement to Terms

Welcome to LearnMate, operated by MD Enterprise. By accessing or using our platform at learnmate.in, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any part of these terms, you may not use our services. These terms apply to all users, including students, tutors, and visitors.

2. Service Description

LearnMate is an online platform that connects students with tutors for educational services. We provide:

• A marketplace for students to find and connect with tutors
• Tools for tutors to create profiles and receive student inquiries
• Communication features for students and tutors to interact
• Payment processing for tutor registration fees
• Location-based matching and search functionality

Important: LearnMate is a platform that facilitates connections. We are not a tutoring service provider. The actual tutoring services are provided by independent tutors.

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access

3.2 Account Types

Student Accounts:

• Free to create and use
• Can browse tutors, send inquiries, and communicate with tutors
• No registration fee required

Tutor Accounts:

• Requires one-time registration fee of ₹118 (₹100 + 18% GST)
• Must provide valid educational qualifications and identity documents
• Subject to verification and approval by LearnMate
• Can create profile, receive inquiries, and connect with students

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our sole discretion.

4. Tutor Registration Fee

4.1 Fee Structure

• One-time registration fee: ₹100 + 18% GST = ₹118
• Payment processed through Razorpay
• Non-refundable except as specified in Section 4.2
• Lifetime access to the platform (no recurring fees)

4.2 Refund Policy

The registration fee is fully refundable under the following conditions:

• If you do not receive any student inquiry within 1 year of registration
• Refund must be requested within 1 year and 30 days of registration
• Account must be in good standing (no violations)
• Refund processed within 7-10 business days to original payment method

To request a refund, contact us at admin@learnmate.in with your account details and payment receipt.

5. User Conduct

5.1 Prohibited Activities

You agree NOT to:

• Provide false, misleading, or fraudulent information
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Post inappropriate, offensive, or illegal content
• Spam or send unsolicited messages
• Attempt to bypass security measures or access unauthorized areas
• Use automated tools (bots, scrapers) without permission
• Violate any applicable laws or regulations
• Circumvent the platform to conduct transactions outside LearnMate

5.2 Tutor Responsibilities

Tutors must:

• Provide accurate information about qualifications and experience
• Maintain professional conduct with students
• Honor commitments and scheduled classes
• Provide quality educational services
• Respond to student inquiries in a timely manner
• Keep profile information up-to-date

5.3 Student Responsibilities

Students must:

• Treat tutors with respect and professionalism
• Provide accurate information about learning needs
• Honor payment commitments to tutors
• Attend scheduled classes or provide advance notice of cancellation
• Provide honest feedback and ratings

6. Payment Terms

6.1 Payment Processing

• All payments are processed through Razorpay, a PCI-DSS compliant payment gateway
• We do not store complete credit/debit card information
• Payment confirmation is sent via email
• GST is applicable on all payments as per Indian tax laws

6.2 Tuition Fees

Tuition fees are negotiated directly between students and tutors. LearnMate does not charge any commission or fees on tuition payments. Payment arrangements are the responsibility of students and tutors.

7. Intellectual Property

7.1 Platform Content

All content on LearnMate, including text, graphics, logos, icons, images, and software, is the property of MD Enterprise or its licensors and is protected by Indian and international copyright laws.

7.2 User Content

By posting content on LearnMate (profile information, messages, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the platform.

You retain ownership of your content and can request its removal at any time.

8. Disclaimers and Limitations

8.1 Platform Disclaimer

LearnMate is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or reliability of information
• Quality of tutoring services provided by tutors
• Results or outcomes from using the platform

8.2 Tutor Verification

While we verify tutor qualifications and identity documents, we cannot guarantee the quality, safety, or legality of tutoring services. Users are responsible for their own due diligence.

8.3 Limitation of Liability

To the maximum extent permitted by law, MD Enterprise shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from user interactions or transactions
• Damages exceeding the amount paid by you to LearnMate (if any)

9. Indemnification

You agree to indemnify and hold harmless MD Enterprise, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms of Service
• Your violation of any rights of another user
• Your content or conduct on the platform

10. Privacy and Data Protection

Your use of LearnMate is also governed by our Privacy Policy. By using our services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

We comply with the Information Technology Act, 2000 and applicable data protection regulations.

11. Dispute Resolution

11.1 Governing Law

These Terms of Service are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bolpur, West Bengal, India.

11.2 Dispute Between Users

Disputes between students and tutors should be resolved directly between the parties. LearnMate may provide assistance but is not responsible for resolving user disputes.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of the platform after changes constitutes acceptance of the modified terms.

Significant changes will be communicated via email or platform notification.

13. Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice, for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Requests by law enforcement or government agencies
• Extended periods of inactivity
• Any other reason at our sole discretion

Upon termination, your right to use the platform will cease immediately.
